Ask an Attorney: I am not a convicted felon, why is my gun purchase being denied?

Q: I am not a convicted felon why is my gun purchase being denied?

A: If you attempt to buy a gun from a Federal Firearms Licensed dealer, a background check will be completed. If the instant background check rejects you, the dealer cannot sell to you. However, you may still be eligible to purchase and possess a firearm. Many times, the rejection is based upon incorrect information in the State and Federal database. For example, if you were arrested when you were 18 and the charges were dismissed you would be eligible, however if the database showed the charges were still open you would be denied. Many cases are resolved in a manner that does not technically result in a conviction.
